Recruit By Week Terms of Service
Thank you for choosing our De Vore Recruiting’s Recruit By Week Service. These are the terms of our agreement.
We provide you the services of a De Vore Recruiting Sourcer.
The Sourcer will:
- Source and screen candidates;
- Provide you candidate resumes with write-ups;
- Set up interviews with your hiring managers;
- Send you a report every day, of that day’s activities (excluding weekends and holidays);
- Have access to Resume Databases such as CareerBuilder, Indeed, Zip Recruiter, Indeed, etc.
- Direct recruit passive candidates from other companies like yours; and
- Be available to you 5 days a week for calls, texts or emails.
We charge a weekly rate of $693 with advertising.
You are charged in advance for one week of service. Our agreement continues week-to-week until you notify us or we notify you of cancellation. You authorize and consent to your credit card being automatically charged the weekly fee on the same day each week as the day you first signed up. (Charges falling on a holiday will be processed either the business day before or the following business day at our discretion).
Either party may cancel at any time. Cancellation is effective at the end of all weekly periods for which you provided payment. To cancel, send us an email at sean@devorerecruiting.com stating clearly your wish to cancel further services after all services for which you paid have been used, or follow the cancellation procedure described at www.devorerecruiting.com. We can cancel further services to you by sending you an email stating clearly our wish to cancel further services after all services for which payment was received have been used. Payments made to De Vore Recruiting are fully earned when paid. There is no full or partial refund, whether for cancellation or other reason. This provision excluding refunds, supersedes any contrary statement in our website.
The Sourcer’s role is limited to screening and submitting candidates for your consideration, assisting in scheduling interviews, and performing tasks in the seven bulleted items, above. The Sourcer will not be involved beyond these services.
De Vore Recruiting will give the Sourcer access to resume databases such as Career Builder, Indeed Resume, and Zip Recruiter.
We are a recruiting company; we earn our revenue by providing recruiting services. It would be unfair of you to hire away our Sourcer without compensating us for recruiting. You agree not to solicit the Sourcer to leave De Vore Recruiting and not to hire the Sourcer directly or indirectly. If you employ the Sourcer directly or indirectly within thirty-six (36) months after the Sourcer is introduced to you or within thirty-six (36) months after the last time the Sourcer provided De Vore Recruiting services to you, then you agree to pay De Vore Recruiting a Recruiting Fee. At the time of entering into this Agreement, the Recruiting Fee is seventy-five thousand dollars ($75,000). De Vore Recruiting has the right to increase this fee from time to time.
DE VORE RECRUITING SERVICE DOES NOT INCLUDE BACKGROUND CHECKING CANDIDATES OR CONDUCTING OTHER INVESTIGATIONS. DE VORE RECRUITING DOES NOT GUARANTEE OR VERIFY WARRANT INFORMATION IN A CANDIDATE’S RESUME OR ANY ASPECT OF THE CANDIDATE. YOU MUST CONDUCT YOUR OWN INTERVIEWS, MAKE YOUR OWN ASSESSMENT, AND INVESTIGATE BACKGROUND IN ACCORDANCE WITH YOUR COMPANY’S LAWFUL PRACTICES AND PROCEDURES. THIS DISCLAIMER SUPERSEDES ANY CONTRARY STATEMENT IN OUR WEBSITE OR ELSEWHERE.
Virtual Assistant Services
If requested, De Vore Recruiting agrees to source a Virtual Assistant (VA) in the Philippines for you to hire and pay directly. If you decide to hire the VA, you agree to pay De Vore Recruiting seven hundred dollars ($700.00) per month as a service fee and one hundred dollars ($100.00) per month as reimbursement of medical insurance costs for the VA for the length of your engagement of the VA’s services.
De Vore Recruiting does not warrant or guaranty the VA’s work. The VA will be hired and managed by you. You agree that you are solely responsible for any liability arising out of the VA’s work given that all instructions to the VA will be provided by you and all work product will be received and reviewed directly by you.
De Vore Recruiting agrees to set up a time tracking management solution to track the VA’s work hours and to provide you with productivity reports created from the data collected from time to time.
If you are paying through ITEX, you will be billed outside De Vore Recruiting, directly through ITEX. You are responsible for making payments through ITEX.
In any dispute that becomes litigation arising from or related to this Agreement, or services provided under this Agreement, the prevailing party will be entitled to recover from the non-prevailing party reasonable costs incurred including staff time, court costs, attorney fees, and all other expenses incurred in the litigation.
These terms are the entire Agreement between your company and De Vore Recruiting regarding the Recruit By Week and Virtual Assistant services. This supersedes all prior communications and discussions regarding these matters. Emails and any other oral and written communications taking place after the effective date of this Agreement, do not modify this Agreement unless they refer expressly to this Agreement and state that they are a modification.
